Welcome to Dr. Sunny Mobile App (“App”), operated by Dr. Sunny Home Healthcare (“we”, “us”, or “our”). By downloading, installing, or using the App, you agree to comply with these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use the App.

These Terms govern your use of the App, services provided through the App, and any content, features, or communication within the App. Dr. Sunny Home Healthcare reserves the right to update or modify these Terms at any time. Updates will take effect immediately upon posting in the App. It is your responsibility to review the Terms periodically.

 

1. Scope of Use

  • The App allows users to book healthcare services at home, including nursing, IV Therapy, Blood Test, Physiotherapy, Doctor visits, and more.

  • Use of the App is restricted to users 18 years or older. Minors are not permitted to create accounts or use services independently.

  • You are granted a limited, non-transferable, revocable license to access the App solely for personal, non-commercial use.

 

2. Emergencies

Do not use the App in an emergency.

If you or someone else experiences a life-threatening situation, immediately dial 998. Examples include:

  • Severe difficulty breathing

  • Uncontrolled bleeding

  • Severe chest pain or suspected heart attack

  • Major trauma, burns, or head injury

  • Severe allergic reactions

  • Loss of consciousness

The App is intended for non-emergency, scheduled or on-demand healthcare services only.

 

3. Account Registration & Security

  • You must create a personal account to book services.

  • Keep your login credentials confidential and do not share with others.

  • You are responsible for all activity on your account.

  • If you suspect unauthorized access, notify us immediately.

 

4. Booking Policies

Types of Bookings

4.1 Book Now – Immediate service:
  • Once a service provider (SP) is assigned, cancellations are not allowed within the first 5 minutes.

  • If you cancel after 5 minutes but before SP arrival, partial charges may apply.

  • If SP reaches your location and you cancel, full nursing/service charges will apply.

4.2 Book Later – Scheduled service:
  • Free cancellation is allowed more than 24 hours before the scheduled time.

  • Cancellation less than 24 hours prior incurs service charges as per your selected service.

  • All bookings are subject to availability, SP assignment, and operational feasibility.

  • The App may display wait times, estimated arrival times, and alternative SPs in cases of high demand.

 

5. Payments

  • Payments are accepted via Visa, MasterCard, Apple & Google Pay and other supported payment methods.

  • A detailed payment breakdown will be shown at the checkout section, including:

    • Nursing/service charges

    • Any extra fees or add-ons (e.g., medical supplies, special care)

    • Applicable taxes or service fees

  • Refunds, if applicable, will be processed to the original payment method within 15 business days.

 

6. Cancellations & Refunds

  • Customer Cancellations: You are responsible for following cancellation rules as stated above.

  • Provider Cancellations: SP cancellations are logged, penalties may apply, and services will be reassigned automatically.

  • Missed Appointments / No-shows: Charges apply if you fail to meet the SP at the agreed time without notice.

  • Disrupted Appointments: If an appointment is disrupted due to circumstances beyond our control, a reschedule, credit, or partial refund may be offered at our discretion.

 

7. Communications

  • The App may send you:

    • Booking confirmations, reminders, and SP arrival updates

    • OTPs and service status alerts

    • In-app chat messages enabling direct communication with your assigned SP

    • WhatsApp marketing messages (offers, promotions, updates) only if consent is provided

    • Policy, security, or system updates

 

8. Use Restrictions

You agree not to:

  • Use the App for any unlawful or unauthorized purpose

  • Share, resell, or commercially exploit the App or its content

  • Interfere with App operations, SP assignments, or other users’ experience

  • Attempt to bypass security or modify the App in any unauthorized way

 

9. Intellectual Property

  • All content, graphics, software, and materials in the App are owned by Dr. Sunny Home Healthcare.

  • You may not copy, redistribute, modify, or create derivative works without explicit written permission.

  • Any user-generated content submitted through the App grants us a worldwide, perpetual, royalty-free license to use it for operational, promotional, or development purposes.

 

10. Liability & Disclaimers

  • The App provides a platform connecting users to healthcare providers, but we do not practice medicine.

  • SPs are independent contractors, and Dr. Sunny Home Healthcare is not responsible for professional decisions made by SPs.

  • The App is provided “as is”; we disclaim warranties of any kind, including accuracy, reliability, or fitness for purpose.

  • We are not liable for indirect, incidental, or consequential damages arising from App use.

 

11. Governing Law

  • These Terms are governed by the laws of the United Arab Emirates.

  • All disputes will be resolved exclusively in UAE courts of competent jurisdiction.

 

12. Termination & Violations

  • We may suspend or terminate your account if you violate these Terms.

  • Termination may be accompanied by legal action and withholding of any pending refunds if applicable.
